Definitions

‘Us’, ‘Our’ and ‘We’ means SNS Supps Pty Limited, (ACN 600623087), trading as The Supplement Stop.

‘Consumer’ means you, the individual who is utilising The Supplement Stop to provide you with a service;

‘Product’ means anything purchased from The Supplement Stop e-Commerce website, including supplements, clothing, vitamins, etc.;

‘Order’ means the order you have placed with us;

‘Head office’ means the Belmont store location, 2/531 Pacific Highway, Belmont, NSW, Australia 2280 ;

‘Website’ means www.thesuppstop.com.au;

‘Transaction’ means you placing an order via our website for which we have received monetary reward

Before you place an order with us

You agree, and warrant that: you have the legal capacity to enter into a contract for the purchase of our product, and; you are over the age of 18 years.

You warrant that you are not permitted to purchase any items for re-sale.

You agree that we are not a manufacturer of the products being sold on our website and are therefore not liable for any adverse reactions or injuries sustained by you, or any other person you provided your purchased products to, following the consumption or use of those products.

You agree that the directions for consumption provided to you on our website are meant as guidelines only and you should always consult your doctor and other health professionals before consuming any supplement or vitamin product.

Your purchase with us

After you have completed the steps required by our website to place your order you will then receive a confirmation email advising that your order has been received.

By placing your order and making payment of same (using PayPal, Afterpay or Zippay), you are warranting that you consent to the transaction.

Payment must be made at the time of check-out. Failure to make payment will not allow your order to be placed and your products to be shipped.

If you have placed an order for a particular product that we do not have in stock, you will be contacted by e-mail or phone and invited to submit an alternate choice.

The price of our products

The price of our products includes GST.

We reserve the right to review the pricing of our products. For any price increases, the prices will be updated accordingly on our website.

Delivery to Metro & Regional Areas (StarTrack)

Our primary method of delivery is to send our products via StarTrack within 24-48 hours (on business days only) of receiving an order and confirmation of payment. Once the orders are picked up by a StarTrack courier, it takes between 1-3 business days for the orders to arrive at the customer’s designated delivery address, depending on their location. The average time-frame for delivery is within 48 hours on business days. During this delivery window, we cannot guarantee a specific time or date for delivery as we are not provided with this information from StarTrack. The exact time and date is dependent on the courier’s workload and is out of our control.

StarTrack will attempt to deliver the customer’s order to the address specified by the customer during checkout. The customer, or someone known to the customer, will need to be present at the address in order to receive the order and sign for it. If StarTrack attempt to deliver the order and there is nobody available to receive and sign for the order, and an authority note has not been given to The Supplement Stop to have the parcel left at the address, the StarTrack courier will leave a note that directs the customer to contact StarTrack to inform them as to where and when they would like the order sent upon a second attempt at delivery. It is the customer’s responsibility to contact StarTrack and organise a second delivery attempt.

Delivery to Remote Areas (Fastway)

If you live in a remote area of Australia that is a significant distance away from a metro area (2-3 hours drive), we will arrange delivery for your products via Fastway instead of StarTrack. We still package and send the order away within 24-48 hours (on business days only) of receiving an order and confirmation of payment. However, once the orders are picked up by a Fastway courier, it takes between 3-8 business days for the orders to arrive at the customer’s designated delivery address, depending on their location. The average time-frame for delivery is within 1 week on business days. During this delivery window, we cannot guarantee a specific time or date for delivery as we are not provided with this information from Fastway. The exact time and date is dependent on the courier’s workload and is out of our control.

Ownership

Ownership of the product passes to you (as the consumer), on receipt of the products.

After you have placed your order, if you change your mind about when you want the order to be delivered, or the flavour/s chosen, please inform our head office immediately. Additional charges may be applied.

We may require the person taking delivery of your products to provide the relevant identification so that we are satisfied that we are delivering your product to the correct address.

We do not accept any liability or responsibility for incorrectly supplied delivery details.

Discounts

New Customer Discount

New customers who register an account on the website and complete their first order will receive 10% off their cart and a free shaker in their delivery.

Note: The customer cannot use the ‘New Customer Discount’ and the ‘Price Match Discount’ at the same time.

Price Match Discount

We will match any competitor’s price provided the following conditions are met.

To receive a price match the customer must choose the desired variation (size and flavour) of the product they want to purchase and then click the ‘Found this product at a lower price?’ link that is visible underneath the ‘Add to Cart’ button. On the next screen, the customer will need to enter the price of the competitor’s product and then paste the URL of the product page on the competitor’s website. The competitor’s product page must show the price entered in order for The Supplement Stop (TSS) to match the price. Once these two fields have been entered, the customer will need to click ‘Send’.

This will trigger a notification to a TSS team member who will review the price match request, check the URL and verify that the price is legitimate. In order for the price to be legitimate, the competitor must be an Australian-based supplement retailer that has at least one bricks and mortar store location in Australia. If the competitor is strictly an Australian-based online retailer, it will be at the discretion of the TSS team member to approve or deny the price match request.

Upon approving the price match request, the TSS team member will trigger another notification that automatically sends a coupon code to the customer via email. The customer will then need to add the product to their cart and enter the coupon code during checkout in order to receive the price match discount.

Note: The customer cannot use the ‘New Customer Discount’ and the ‘Price Match Discount’ at the same time.

Free Shipping Discount

Customers who add over $150 worth of product to their cart will automatically receive free shipping during checkout.

Risk and title

Our products are your risk from the time of delivery.

Ownership of the products passes to you when we are in receipt of full payment from you, in accordance with the payment provisions as set out on our website.

Warranty and Guarantee

Our products comply with the guarantees and warranties that are mandatory in accordance with Australian Consumer Law.

You are entitled to a refund or replacement. You are entitled to a refund for a major failure, and you are entitled to a replacement if our products fail to be of an acceptable quality.

We guarantee that our products are of an acceptable quality, are fit for their purpose and that they match their description.

Limitation of liability and your use of our website

Our website is governed by the laws of New South Wales, and upon entering and accessing our website, you warrant that you agree to same.

It is a condition of your use of our website that we will not be liable for any loss or damage, (howsoever caused, including and not limited to your negligence, personal injury, death, damage, loss of property, damage to your computer, loss of your computer’s data), and whether or not that loss is a result of your contract or implied contract with Flexfit meals.

You must ensure that you take reasonable precautions when accessing our website to protect yourself from viruses or other interference that has the propensity to damage your computer or device otherwise.

The usage of your personal information, when accessing our website, is set out in full in our Privacy Policy.

We reserve the right to vary and or amend the Terms and Conditions from time to time.

Your purchase and interaction with us is subject to the Terms and Conditions that are in force at that time.

Any changes or amendments to the Terms and Conditions will be published on our website accordingly, together with the date that the Terms and Conditions were updated.
